philosoher "jean Jacques ROUSSEAU" in the eighteenth century and rulers and judicial independence and recruitement the world over, have taken his saying in the hearts!For instance, on the (13th of AUGUST), former ivorian president who seems to be lawfully and constitutionnally the current president of the "Ivory Coast" goes back ontrial to challenge the Western judiaciary power on suspected charges grounds, targeted at him since the ivorian turmoil in 2010!(...)"Reminder of the major facts in the "IVory COAST):"President "Laurent Gbagbo" has been arrested illegally under the the french neo colonial army forces permanent air raids! A so called international conspiracy of the main westrn power structures versus a post independence proud and determined african leader f the new millenium. Down the line, "Laurent Gbagbo" has been deported to the Netherlands behing closed doors!(...)But right now, objective international observers keep on asserting that the trial of "Laurent Gbagbo" can be increasingly labeled as a political settling of scores on neo colonial and imperialist judiciary grounds and huge economic interest in the "gulf of GUINEA", namely as far as the huge ivorian oil interests are concerned in the "IVORY CoaSt": To some extent, it will be the trial of a new form of imperialism and neo colonialism in french Africa inpost african independence! As a result, the international justice(LA HAYE in the Netherlands) should not be a selective and manipulated justice targeted at the weakest third world states of AFRICA... That seems to be the core issue of the current international judicial independence and recruitment today in the NETHERLANDS!("SPOTLIGHT ON THE JUDICIAL INDEPENDENCE AND RECRUITMENT Nowadays):"Liberal democracies accept judicial independence as fundamental to the rule of law. For instance, in "Britain" and in the american federal judiciary, judges holds office for life during "good behaviour". Moreover, the judiciary is more closely controlled by the state in most western Europe than in "BRITAIN" or the United states, but security of the judicial tenure is till well established. In fact, judges appointed during the fascist era in "ITALY" and "GERMANY" were embarrassingly hard to remove afterwards. Similar problems are likely to be encountered in "Gemany" with judges from the former GERMAN DEMOCRATIC REPUBLIC. Furthermore, the issue of judicial independence raises the problem of how judges are selected... Meanwhile, an independent judiciary is not necessarily a neutral judiciary. Judges generally see it as their task to uphold the dominant values of society in order to stabilise the social order. Many observers see this as the fundamental function of law! In "Great BRITAIN", some writers see a conservative bias in the higher judiciary, shown by unfavourable attitudes to the trade union movement (REFERENCE BOOK GRIFFITH-1977).More disturbing, perhaps, has been the record of judicial conduct intrials involving alleged Irish Republican ARMY (IRM) terrorists. On the other hand, senior judges, supposedly guardians of the criminal justice system, seemed unable to prevent or even rectify palpably unsafe verdicts. "In consequence, british justice was seriously discredited"! AS a matter of fact, the problem in our view, stems more from professional arrogance than from ideoligical bias or the upper-class social backgrounds of judges. Basically senior judges were loath to admit that the criminal justice system could make every serious mistakes... As far the Unites states of America is concerned, behavioural research into judicial behaviour has shown clearly that judges' decision in court are strongly related to their political views but the effect of social background on judges' views appears to be fairly weak(reference-book-SCHUBERT 1972). As a result, widening the recruitment base of the judiciary is intrinsically desirable, but will do little to alter its fundamentally conservative role! "NOW, when coming back to the facts of the next trial of former ivorian president "LAURENT GBAGBO" in the "Netherlands", we keep on wondering fundamentally, what will the core bias of the orientation of the verdict? Imperialist or neo colonial bias or unexpected hidden reasons? But our strong feeling grounded in conspicuous facts still confirms the fact that, third world states, particularly african states seem to be ready to say no to manipulated and selective international justice in this new historical trial of "LAURENT GBAGBO" (AUGUST 13TH)-Therefore, international justice must be done, no partiality! WAIT AND SEE, because when there is a smoke, there is also fire, someone said in the USA..
